1. About PalitBay
PalitBay is an online marketplace platform intended to connect people in local communities in the Philippines.Users may use PalitBay to create listings, browse listings, contact other users, buy, sell, swap, or otherwise arrange transactions directly with one another.PalitBay provides the platform and related services but is not normally a party to transactions between users.
2. Acceptance of These Terms
By creating an account, accessing PalitBay, submitting a listing, or using any PalitBay service, you agree to comply with these Terms & Conditions.If you do not agree with these Terms, you should not use PalitBay.These Terms apply together with the PalitBay Privacy Policy and any additional rules or requirements displayed on the website.
3. User Accounts
Users must be at least 18 years old to create an account or use PalitBay. By creating an account or using PalitBay, you confirm that you meet this age requirement.
To use certain PalitBay features, you must create an account using a valid email address and password.You are responsible for: providing accurate information; keeping your password confidential; keeping your account secure; using only your own account; and notifying PalitBay if you believe your account has been accessed without authorization.You must not create accounts for fraudulent, abusive, misleading, or unlawful purposes.PalitBay may restrict, suspend, or terminate accounts that violate these Terms or are otherwise involved in abuse, fraud, or activities that may harm other users or the platform.
4. Listings
Users are responsible for all listings they create.You must ensure that your listings: accurately describe the item, service, or opportunity being offered; contain truthful and reasonably complete information; use appropriate photographs or other media; do not deliberately mislead other users; are placed in the appropriate category; and comply with these Terms and applicable laws. You must not knowingly provide false information about an item's condition, ownership, availability, price, location, or other important characteristics.
Sold or No Longer Available Items
Sellers are responsible for keeping their listings accurate and up to date. Once an item has been sold, swapped, reserved, or is otherwise no longer available, the seller must promptly mark the listing as “SOLD / NO LONGER AVAILABLE” or remove the listing from PalitBay. Sellers must not leave an item listed as available when it is no longer available. Failure to update or remove an unavailable listing may result in the listing being removed by PalitBay and, in repeated or serious cases, further action being taken against the account.
5. Prohibited Listings and Activities
PalitBay must not be used to offer, promote, arrange, or facilitate unlawful activities or prohibited goods or services.Listings or activities involving illegal goods, stolen property, counterfeit goods, fraudulent activities, or other unlawful transactions are prohibited.PalitBay may remove listings or restrict accounts where there is a reasonable basis to believe that these Terms or applicable laws have been violated.
6. Buying, Selling and Trading
Transactions arranged through PalitBay are agreements between the participating users.Users are responsible for deciding whether to proceed with a transaction and should independently consider the identity of the other party, the condition and authenticity of an item, the agreed price, and any other relevant circumstances.PalitBay does not guarantee that: a listed item exists or is available; an item is authentic or accurately described; a seller or buyer will complete a transaction; a payment will be made; an item will be delivered; or a transaction will meet either party's expectations.
7. Swaps and Exchanges
PalitBay may allow users to offer items for exchange or trade.A swap is an agreement between the participating users. Users should inspect items carefully and agree on the conditions of the exchange before completing it.PalitBay does not guarantee the condition, value, ownership, authenticity, or suitability of items exchanged between users.Fraudulent or deliberately misleading swap activities are prohibited.
8. Payments and GCash Safety
PalitBay does not require users to send money to PalitBay in order to complete ordinary transactions between users.Where users choose to use GCash or another payment method, the transaction is made directly between the participating parties.Users should: verify that a payment has actually been received in their own account; not rely solely on screenshots or payment confirmations sent by another person; never provide their GCash PIN, OTP, password, or other security credentials to another user; and exercise caution before sending money to someone they do not know.PalitBay does not guarantee or insure payments made between users.
9. User Safety and Communication
Users should exercise appropriate caution when communicating or meeting with other users.Where possible, users should: communicate through appropriate channels; avoid sharing unnecessary personal information; meet in a safe public location when meeting someone in person; inspect an item before completing a transaction where practical; and avoid sending advance payments when they are uncertain about the other party.Users are responsible for making their own decisions about whether a transaction or meeting is safe.
10. Reporting Listings and Users
Users are encouraged to report listings or accounts that appear to violate these Terms, involve fraud, contain prohibited material, or otherwise present a serious concern.PalitBay may review reports and may remove listings, restrict accounts, suspend users, or take other appropriate action.Submitting a report does not guarantee that PalitBay will take a particular action.
11. Content Submitted by Users
Users retain responsibility for the content they submit to PalitBay, including listing descriptions, photographs, messages, and other materials.By submitting content, you confirm that you have the necessary rights or permission to use that content and that its publication does not knowingly violate another person's rights.You must not submit content that is unlawful, fraudulent, defamatory, abusive, threatening, misleading, or otherwise prohibited by these Terms.
12. PalitBay's Role and Limitations
PalitBay provides an online platform for users to discover and communicate about listings.Except where expressly stated otherwise, PalitBay does not act as: the seller of items listed by users; the buyer of items listed by users; an agent for either party; a payment processor or holder of transaction funds; or a guarantor of transactions between users.PalitBay is not responsible for the quality, safety, legality, authenticity, ownership, availability, or condition of goods or services offered by users.Users are responsible for conducting their own checks and making their own decisions before entering into a transaction.
13. Suspension and Termination
PalitBay may remove content or suspend, restrict, or terminate an account where necessary to: enforce these Terms; protect users or the platform; investigate suspected fraud or abuse; comply with applicable law; or address activity that presents a security or safety risk.Where appropriate, PalitBay may also remove listings that violate these Terms.
14. Privacy
PalitBay collects and processes personal information in accordance with its Privacy Policy.The Privacy Policy explains what information PalitBay collects, why it is processed, how it may be shared, and the rights available to users.
15. Availability of the Service
PalitBay aims to provide a reliable service but does not guarantee that the website or all features will always be available, uninterrupted, or error-free.PalitBay may modify, suspend, or discontinue features or parts of the service where reasonably necessary.
16. Changes to These Terms
PalitBay may update these Terms & Conditions from time to time to reflect changes to the platform, its services, applicable requirements, or operational practices.The updated version will be published on this page with a revised Last updated date.Continued use of PalitBay after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
17. Applicable Law and Disputes
Users should first attempt to resolve transaction-related disputes directly and in good faith with the other party.Where a user believes that a listing, account, or transaction-related activity involves fraud, prohibited items, misleading information, abuse, or another violation of these Terms, the matter may be reported to PalitBay for review.
PalitBay may request relevant information or evidence and may review available platform records, including listing information, account information, reports, and relevant communications or activity logs where available.
PalitBay may take appropriate action where warranted, including removing or restricting listings, restricting or suspending accounts, or taking other measures permitted under these Terms.
PalitBay is not normally a party to transactions between users and does not guarantee, mediate, or resolve ordinary disagreements concerning price, item condition, ownership, authenticity, payment, delivery, collection, swaps, or other transaction terms. Such matters remain primarily between the participating users unless
PalitBay determines that platform rules, user safety, fraud, unlawful activity, or another legitimate platform concern requires intervention.Nothing in these Terms is intended to remove or restrict any rights or protections that cannot lawfully be excluded or limited.
